Terms of Service

These terms are an agreement between you and GFTY Box, Inc. ("GFTY," "we," "us"). By creating an account or using GFTY, you accept them. If you don't agree, please don't use the service.
1. What GFTY is
GFTY is a gift recommendation service. We keep track of the people and occasions you add and suggest gifts that fit. GFTY is not a store: we don't sell, hold, or ship goods, or process payment for gifts. When you choose a gift, we send you to the retailer's website, and your purchase is between you and that retailer, on their terms. Questions about payment, shipping, returns, and refunds go to them.
2. Your account
You must be at least 18 and able to enter a binding contract. You're responsible for activity under your account and for keeping your login secure. Tell us promptly if you think someone else has access.
3. Information about other people
When you add someone, you confirm that you know them personally, that you're sharing only what you're comfortable sharing on their behalf, and that you have any consent the law requires. Don't add people you don't know, don't use GFTY to track or surveil anyone, and don't add sensitive information we haven't asked for. If a recipient asks us to remove their information, we will.
4. Recommendations and their limits
Recommendations are generated with the help of artificial intelligence. We work to make them good, but we don't promise that an item will be in stock, that a retailer's price, description, availability, or shipping estimate is accurate, that an item will arrive by a particular date, or that a gift will suit its recipient. Prices and availability change without notice to us, so please confirm both at checkout.
5. You approve every purchase
GFTY doesn't buy anything on your behalf. Every purchase requires your approval and is completed by you at the retailer. If we ever offer a feature that changes this, it will be opt-in and clearly explained.
6. Affiliate links
We earn commissions on some purchases made through our links. This never changes the price you pay. Our Affiliate Disclosure explains how it works.
7. Acceptable use
Don't use GFTY to break the law, harass anyone, infringe anyone's rights, or gather information about someone without a genuine gifting purpose. Don't scrape, reverse engineer, resell, interfere with, upload malicious code to, or attempt unauthorized access to the service.
8. Early-stage service
GFTY is in active development. Features may change or stop working, data may occasionally be lost, and availability isn't guaranteed. If something goes wrong, we'd like to hear about it.
9. Fees
GFTY is currently free. If we introduce paid features, we'll show you the price and get your agreement before charging you.
10. Our intellectual property
GFTY™, the GFTY name and logo, this site, and our curation methods belong to GFTY Box, Inc. and are protected by trademark, copyright, and other laws. Using the service doesn't give you ownership of any of it.
11. Your content
The information you enter stays yours. You give us a license to use it to operate and improve GFTY, including learning from your approve, change, and skip decisions. That license ends when you delete the information, except for aggregated data that no longer identifies you or your recipients.
12. Ending your account
You can close your account at any time from your settings or by emailing us. We may suspend or close an account that violates these terms or creates risk for others. Sections 4, 10, 13, 14, 15, and 16 survive termination.
13. Disclaimer of warranties
GFTY is provided "as is" and "as available." To the fullest extent permitted by law, we disclaim all warranties, express or implied, including merchantability, fitness for a particular purpose, non-infringement, and any warranty arising from course of dealing or usage of trade. We don't warrant that the service will be uninterrupted, timely, secure, or error-free.
14. Limitation of liability
To the fullest extent permitted by law, GFTY Box, Inc. and its officers, directors, employees, and agents will not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, or for lost profits, data, goodwill, or other intangible losses, arising from your use of the service.
Our total liability for any claim relating to GFTY will not exceed the greater of the amount you paid us in the twelve months before the claim, or one hundred dollars ($100).
Some jurisdictions don't allow certain limitations, so parts of this section may not apply to you.
15. Indemnification
You agree to indemnify and hold harmless GFTY Box, Inc. from claims, damages, and expenses (including reasonable attorneys' fees) arising from your use of the service, your violation of these terms, your violation of anyone's rights, or information you provided about another person.
16. Governing law and disputes
These terms are governed by the laws of the State of Texas, without regard to conflict of laws principles. Any dispute will be brought exclusively in the state or federal courts located in Bexar County, Texas, and you consent to their jurisdiction.
Before filing anything, please email us at hello@getgfty.com and give us 30 days to resolve it.
17. Changes to these terms
We may update these terms. For material changes, we'll notify you by email or through the service at least 14 days before they take effect. Continuing to use GFTY after that means you accept the updated terms.
18. Miscellaneous
These terms, together with our Privacy Policy and Affiliate Disclosure, are the entire agreement between us. If any provision is found unenforceable, the rest stays in effect. Our failure to enforce a provision isn't a waiver of it. You may not assign these terms; we may assign them in connection with a merger, acquisition, or sale of assets.
